Flying Boy Posted June 27, 2007 Posted June 27, 2007 Hi Guys, The smoking ban is almost upon us and I was wondering if anyone can answer this question. I have an engineer that smokes. I have installed no smoking signs in the van that this engineer uses and his contract states no smoking in the vehicle. If the engineer smokes in his van and gets caught who pays the fines? The keyword there is business.

Well,unless there is a difference in the ban that came in here (NI) you are permitted to drive in a works vehicle provided it is for your sole use and is not a shared vehicle (ie - pool car or van,council/local authority vehicle etc).

The private vehicle for the small business owner is like the homeworker - unless you actually employ people to work in your home for business or have members of the public visiting it for same purpose then it is not covered (a lot of this is like the "too bent" banana stories!).
