Scotmod Posted November 11, 2012 Posted November 11, 2012 To be fair with Jef though, Construction always has and will be like this. Christ, even with things such as JCT etc you still have disputes and mediation. Not many like it but "thems the rules, son"
MrHappy Posted November 11, 2012 Posted November 11, 2012 To be fair with Jef though, Construction always has and will be like this. gosh really, well that makes it all okay then..... Mr Veritas God
jb-eye Posted November 11, 2012 Posted November 11, 2012 gosh really, well that makes it all okay then..... I did say "it wasn't nice and I'm glad I'm out of contracting" most of you guys won't have ever experienced contract law or ever entered into a NAM JCTcontract or been to mediation. There is a level of contracting where the ignorant or nieve get eaten for breakfast.I've said this more than once: this is the easiest thing I have ever done. Customers!
Scotmod Posted November 12, 2012 Posted November 12, 2012 gosh really, well that makes it all okay then..... I'm not saying its ok but there is a whole nother level of contracts above the scope of 95% of the companies on here. Has anyone here bar maybe jeff and some national cos that have worked with retentions/liquidated damages/JIT contracts? It's not a nice place to be as a subby. You just want to sign the paper and crack on with the job, it's in the main contracts interest to claw back as much as they can, this is how they price their jobs, by robbing the subbies to increase their margins because a lot of the time the person signing the contract on behalf of I.B Alarms doesn't actually read it. You knowin your tenders where it states that you must remove all of your own waste from site, but chuck it in the skip anyway? There was one site in Edinburgh where the contract paid a labourer £7 an hour to sit at the skips and take a note of who and what used them when they weren't supposed to. Hit with damages of £25 a time, imagine how many times you do it again. They raked back £15k+ at the cost of one labourers work. What could the subbies do? Nothing! They signed on the line saying they would take it back themselves. It's e nature of the beast and those who can tame it aren't worth their weight in gold in the minefield that is construction contract work.
MrHappy Posted November 12, 2012 Posted November 12, 2012 is "gosh really.." still a suitable sardonic reply ? you learn about contracting by getting f#cked over, a fire or security co. has little need to be involved with this market as you ain't going to get a signed maint contract by the end user, Mr Veritas God

Practice in the morning, practice at night. Practice in the evening, until you get it right. Only make sure you are practising in the right way at the right time for it.
